Mark’s primary emphasis has been on insurance coverage in the energy industry. Among various energy industry issues he has handled coverage disputes concerning offshore pipelines, floating production platforms, fixed production platforms, steam turbine failures, sunken dry docks, oil reclamation plants, saltwater injection wells, directional drilling equipment, seismic damage from directional drilling operations, directional drilling deviations, above ground floating roof storage tanks, climate change, toxic or mass tort, pipeline construction, bumper shoot policies, maritime policies and commercial general liability policies. He has also handled coverage issue concerning hotels & restaurants, dram shop, assault, timber harvesting, theft, construction defect, necrotizing fasciitis, multi-family housing, false imprisonment, advertising injury, errors, mission, wind & hail.

I have subrogated maritime losses involving damage to fixed off shore platforms and pipelines struck by drifting MODUs and pipelines dredged up by MODU anchors as well as land based matters concerning drilling completions, production, truck accidents, generator failures, compressor failures, oil refinery fires, frack equipment fires, crane collapses and ROVs. I have handled numerous issues concerning indemnification provisions in oil and gas services contracts under Texas, Oklahoma, Louisiana and New Mexico law. I have handled defense cases concerning trucking accidents, floodwater diversion, sport shooting ranges, premises liability, assaults, breach of service contracts, construction defects, product defects, downhole tools, loss of reserves, railroad accidents, auto accidents and dram shop cases.

Recoveries:

  • Settlement arising from a semi-submersible drilling rig’s anchor fouled on an 18-inch natural gas pipeline located on the Outer Continental Shelf in Viosca Knoll Block 992 off the coast of Louisiana.

  • Settlement arising from a refinery fire in Krotz Springs, Louisiana. Said fire was caused by a contract maintenance crew breaking a bleeder valve on the bell end of a heat exchanger in a reformer unit, venting liquid propane into the facility.

  • Settlement arising from a semi-submersible drilling rig which broke loose in Hurricane Rita, drifting 140 miles and dredging up client’s undersea 20 inch gas pipeline before coming to rest in Eugene Island Block 133 in the Gulf of Mexico off the cost of Louisiana.

  • Settlement arising from a semi-submersible drilling rig which broke loose in Hurricane Rita, drifting 140 miles and dredging up client’s 8 inch undersea gas pipeline and shutting in client’s production platform before coming to rest in Eugene Island Block 133 in the Gulf of Mexico off the cost of Louisiana.

  • Settlement arising from a fire which destroyed a frack truck and other equipment at a wellhead. The fire was caused by a defective fuel injection component.

  • Settlement arising from a frac truck forced off the road by a fruit truck on Interstate 20 in Midland County, Texas. Client’s frac truck was destroyed by fire in the accident. Roadway was strewn with limes, lemons and avocados but the cilantro was also destroyed by the blaze

  • Settlement for damage to a nitrate furnace in Fort Worth. The furnace was damaged when the nitrogen supply system malfunctioned, causing an explosion when liquid nitrogen pooled in the bottom of a carbon steel surge tank.
