An experienced litigator with thirty years of diverse trial experience in Texas state district courts and federal courts, Pam has tried more than thirty-five jury trials to verdict and has handled ten appeals.

Practice areas include casualty defense, breaches of contract, trade secret theft, civil fraud, business torts, employment matters, property disputes, copyright, trademark, employment matters, and other general civil litigation.  Additionally, she is skilled in handling Temporary Restraining Order and Temporary Injunction hearings for businesses and individuals. 

Her administrative law work includes representation of clients before the EEOC, Texas Workforce Commission’s Civil Rights Division, and in Texas SOAH bench trial proceedings. Client representation in non-litigation matters include business model development, contract negotiation and drafting, internal investigations, employment solutions, litigation avoidance, and staff training.  

Pam is an Arbitrator, registered with FINRA and a Certified Mediator in the State of Texas. 

NOTABLE CASES:

  • Successfully obtained a full defense jury verdict in a civil rights case brought in federal court under §1983 in which plaintiff sought $30,000,000.00 for wrongful conviction after serving 15 years in prison. Although upon writ, the Texas Court of Criminal Appeals had previously ruled that plaintiff’s constitutional rights were violated, Pam obtained a full defense verdict in which the jury found the county was not liable. Gandy v. Harris County (U.S. District Court, Southern Dist. of Texas).

  • Prevented a class certification in an action brought in federal court under the Fair Labor Standards Act by claimants who sought reclassification and thousands of hours of overtime pay, thereby inhibiting hundreds of exempt claimants from taxing the employer for retroactive and future overtime costs. Moreau, et. al. v. Harris County (Harris County, Texas).

  • In a multi-vehicle accident in which truck leasing company and driver were sued for $1,700,000.00 in actual damages and even more in purported exemplary  damages, and in which liability was clearly against client, Pam successfully challenged expert testimony of plaintiffs’ medical, life care plan, and economist experts to convince jury to award less than $17,000 for both plaintiffs, representing a judgment of less than 1% of the damages sought. Brown v. Matco Tool, et al. (Jefferson County, Texas).

  • Successfully defended precious metals plating company in a non-competition action in which Plaintiff sought $1.500,000.00. During trial, Pam successfully prevented expert testimony of future damages and limited testimony on past damages, using procedural and substantive bases for exclusion of evidence. While liability was clearly against defendant, the jury awarded Plaintiff less than $14,000 – a judgment of less than 1% of Plaintiff’s demand and purported loss. Plaintiff appealed the verdict, challenging the ruling excluding evidence, and Pam further prevailed for client in the appeal.

  • Obtained a full defense verdict for employer at trial in which a former executive sought over $1,000,000 monetary damages on his claim for breach of employment agreement.

  • Successfully represented an emergency room physicians’ staffing company in a pre-litigation matter by negotiating a favorable walk-away resolution between client & the hospital system, averting costly, risky litigation against client under a multi-million dollar contract.

  • Achieved a culturally-sensitive resolution of a flood plain eminent domain case in a historical, African American neighborhood in which Pam’s client had deep family roots. The government agreed to place a commemorative plaque at nearby bridge honoring the client’s mother, a beloved school teacher whose honorable career had touched many young lives in the community.

  • Won a jury verdict for client in a property dispute in which adjoining landowners each laid claim to a significant parcel between them, in a case that centered on a battle of the experts. During trial, Pam obtained key admissions during cross-examination of opponent’s expert resulting in a jury award of the land to Pam’s client.
