Tommy brings over thirty five (35) years of experience on both sides of the docket to his trial practice.  His diverse background began at Vinson & Elkins doing medical defense work and then to a boutique practice representing the victims of serious medical negligence conduct. His ability to handle cases on both sides of the docket led him to doing complex energy related defense work at Phillips and Akers before ultimately joining the subrogation team at Donato Brown. Tommy has recovered tens of millions of dollars in representing domestic and international insurers in third party subrogation cases across the United States. From explosions in refineries in Valdez, Alaska to salt water disposal site fires in Colorado, and North Dakota, Tommy has a subrogation practice that is national in scope. He continues to handle all varieties of product defect /failure cases, adverse publicity, government recall issues, adulterated or contaminated food stock or food product cases as well as product tampering cases.

Tommy’s defense practice is mainly located to the State and Federal Courts in Texas. His vast knowledge of the plaintiff’s practice, the judges, lawyers and experts often retained and their litigation background and experience sets apart Tommy’s ability to evaluate, develop and try cases. His background in medical negligence has him on a first name basis with many of the best physicians Houston and allows him to quickly understand both the strengths and weaknesses of the damage aspect of the personal injury and death cases he handles across Texas. He handles every type of personal injury defense, from 18 wheeler collisions to gross negligence employee death cases to Dram Shop defense matters.

Tommy was recently put in charge of subrogation claims based on a series of losses at salt water disposal facilities due to lightning strikes occurring at sites protected by a new type of lightning protection technology. Over the course of the litigation, the cases were developed to the point that all settled with the most recent ones not even moving beyond the exchange of written discovery. As a result of his expertise, Tommy was asked by IEEE to present a three part paper on lightning protection and the success rate of the new technologies. The second installment of that presentation will take place in Atlanta in September of 2020. Tommy’s subrogation practice includes product contamination cases in Colorado and North Dakota, recalled gaskets in Rhode Island, defective oilfield equipment supplied by foreign defendants and chemical explosions in West Texas.  He has successfully sued manufacturers in Taiwan and mainland China under both state law and the Hauge Convention.

Notable Cases:

Tommy has tried numerous cases first chair and in 1999, obtained a $9.8 million dollar verdict in a severed burn case in Harris County. In addition to the lightning protection settlements, Tommy has obtained millions of dollars of recovery involving energy related subrogation claims.
